Коротенькое, на одну страничку, письмо со ставшим знаменитым 8-м параграфом: "Decisions by the Secretary pursuant to the authority of this Act are non-reviewable and committed to agency discretion, and may not be reviewed by any court of law or any administrative agency." Напоминает требование выкупа (ransom note) - гоните денежки, а то капец вашему маркету и не смейте обращаться в полицию! Умри бин Ладен или Путин, лучше не напишешь!

Формула, довольно часто встречающаяся в текстах законов, особенно касающихся обороны, безопасности и т. д. А в каком, интересно, суде можно оспорить законность закона? Только в Верховном. Но ничего неконституционного в нем нет. Или речь идет о соответствии действий министра финансов закону?

I don't see why the US needs to reinvent a solution, and especially a bad one like the proposed Buffett ransom note, when Sweden has managed to go through something very similar in the early 1990's and used a bailout plan which worked decently:
